By purchasing a ticket to, or attending, any event produced or presented by Moonlit Productions, LLC (“Moonlit Productions,” “we,” “us,” or “our”), you (“you” or “Attendee”) agree to the terms of this Event Waiver, Assumption of Risk & Photo Release (the “Waiver”).
If you do not agree to these terms, please do not purchase a ticket or attend our events.
1. Assumption of Risk
You understand and agree that:
- Attendance at live events may involve crowds, loud sound, lighting effects, and other environmental factors.
- These conditions may create risks of personal injury, property damage, or other harm.
- You voluntarily choose to attend and assume all such risks, whether known or unknown, that may arise out of or relate to your attendance, except to the extent caused by our gross negligence or willful misconduct.
If you have any medical conditions, sensitivities to sound or lighting, or other health-related concerns, you are responsible for assessing whether attendance is appropriate for you and seeking medical advice if needed.
2. Release of Liability
To the fullest extent permitted by law, you:
- Release and discharge Moonlit Productions, its owners, employees, contractors, agents, volunteers, and partners (collectively, the “Released Parties”) from any and all claims, demands, or causes of action for injury, loss, or damage (including personal injury, property damage, and wrongful death) that may arise out of or relate to your attendance at our events, except to the extent caused by the gross negligence or willful misconduct of a Released Party.
- Agree not to sue the Released Parties for any such claims, except as expressly allowed by applicable law.
Some jurisdictions limit how much liability can be waived; this Waiver is intended to be enforced to the maximum extent permitted by law.
3. Personal Belongings & Conduct
- You are responsible for your own personal belongings at all times. We are not responsible for lost, stolen, or damaged items.
- You agree to follow all venue rules, staff instructions, and posted signage, and to behave in a respectful and safe manner.
- We reserve the right to refuse entry or remove any attendee who violates rules, appears intoxicated, is disruptive, or poses a risk to themselves or others. No refunds will be given in such cases.
4. Alcohol & Age Restrictions (If Applicable)
If alcohol is served or allowed at an event:
- You must be 21+ with valid government-issued ID to consume alcohol.
- You agree to drink responsibly and comply with all applicable laws.
- We and the venue reserve the right to decline service or remove anyone whose behavior is unsafe or inappropriate.
Certain events may be 18+ or have other age requirements, which will be stated in event details. You are responsible for ensuring you meet the minimum age requirements for entry.
5. Health & Safety
You agree that:
- You will not attend an event if you are feeling seriously ill or have been advised by a medical professional not to attend crowded events.
- You will comply with any health and safety measures in effect at the time of the event (e.g., venue rules, posted guidelines, government regulations).
6. Photo, Video & Audio Recording Release
By attending a Moonlit Productions event, you:
- Acknowledge that the event may be photographed, filmed, or otherwise recorded by us or our partners.
- Grant Moonlit Productions a perpetual, worldwide, royalty-free license to use your likeness, image, voice, and appearance as captured in any photos or recordings made at the event, in any media now known or later developed, for promotional, marketing, or archival purposes, without compensation.
- Waive any right to inspect or approve the final use of such materials.
If you have a serious concern regarding recognizable images of you, contact us at contact@moonlit-productions.com and we will review the situation in good faith, subject to practical and legal limitations.
7. Minors
If you are a parent or legal guardian of a minor attending an event:
- You represent that you have the authority to agree to this Waiver on behalf of the minor.
- You accept full responsibility for the minor’s attendance and behavior at the event and agree to all terms of this Waiver on their behalf.
Some events may be 18+ or 21+ only. Please check event details before purchasing tickets.
8. Governing Law
This Waiver is governed by the laws of the State of Georgia, without regard to conflict of law principles. Any disputes arising out of or relating to this Waiver or your attendance at our events shall be brought exclusively in the state or federal courts located in Whitfield County, Georgia.
9. Acknowledgment
By purchasing a ticket or attending a Moonlit Productions event, you acknowledge that you have read, understood, and agree to this Event Waiver, Assumption of Risk & Photo Release, and that you are doing so voluntarily.
If you do not agree, please do not purchase a ticket or attend our events.
